You are hereby requested to read all these conditions carefully, as you shall be bound by them.
Your contract: All the tours in this itinerary are operated by Equino Fun Holidays. When a booking is accepted by us, it constitutes a contract between you and Equino Fun Holidays. All bookings are taken on the basis that you accept these terms and conditions. We are travel organizers only. We do not control or operate any airline, neither do we own or control any shipping company, coach company, hotel, transport, or any other facility or service mentioned in this itinerary. We take care in selecting all the ingredients in your holiday, but because we only select and inspect them and have no other control in their running, we cannot be held responsible for any injury, death, loss or damage, or deficiency in services, caused by the act or default of management or employees of an independent contractor arising outside our normal selection and inspection process. (The contract and the disputes, if any, will be subject to the jurisdiction of Mumbai courts only).
Booking and payment: A non-refundable and interest-free deposit of Rs.10,000/- per person is required to be paid by the passenger at the time of booking/ registration which should be done at least 45 days prior to the date of departure. Full payment should be made 30 days prior to the date of departure.
Validity: Itineraries, resorts, hotels and prices are subject to change any time without prior notice.
Prices: All rates are calculated as on February 2005. Any increase in air/ cruise fare prior to the date of departure or change in exchange rates, leading to an increase in the surface transportation and land arrangements, will have to be borne by the passenger. (Rate of exchange calculated at
1 US $ @ Rs.44; 1 EURO @ Rs.58).
Note: The company shall not accept any liability or responsibility for any damage, loss, injury, accident, death, delay, breakdown or irregularity, which may occur while carrying out the tour arrangements. (In the event of a passenger falling ill or suffering any accident during the journey, all hospital expenses, doctor fees, repatriation expenses, any other charges incurred as a direct or indirect result of his/ her illness / accident are the responsibility of the passenger). The management reserves the right to claim any additional expenses due to delay or changes in train, airplane, bus, ship or other service, weather conditions, strikes, war, quarantine, any other cause whatsoever and all such loss or expenses must be borne by the passenger.
Cancellation: In the event of the cancellation of a tour, the following are payable in addition to the visa fees, insurance charges, cruise cancellation charges, etc. already incurred.
Note: The above will hold good only on the presentation of the original receipt. Transfer from one tour to another will be treated as a cancellation. All cancellation must be received in writing and signed by the tour participant, who made the booking. In case you have to withdraw from a tour after it has begum for reason such as illness, be sure to obtain a medical certificate in support of any insurance claim.
We regret that we are not able to make refunds for absences from a tour or for any missed sightseeing. Costing and airfare for all tours is based on departure from Mumbai, unless specifically mentioned. Passengers opting for boarding flights from other places will have to pay the airfare difference (if any) and bear expenses of airport to hotels and vice versa transportation, with no reduction in the price on this account. The facility of offering the option of boarding the flight from other places will be solely at our discretion. We, in o circumstances, will be liable for any loss of baggage, goods, air tickets, passport, cash, traveller's cheques, or any other travel document or item owned by the passenger while on tour, whatever the cause. No refund is permissible on partially utilized air tickets or ground arrangements.
Important:
- Every tour is subject to RBI/ GOI approval. Timings / itineraries are subject to change without prior notice.
- Equino Fun Holidays reserves the right to cancel any tour. In both cases, the company shall not be liable for any damage / loss / additional expenses suffered by the passengers.
- In-flight meals are not included in the tour cost. If there's a change in any flight schedule and meals are not served, expenses for the same will have to be borne by the passengers. The company shall not compensate for the same.
- Optional tours taken by the passengers will be at their choice.
- The company shall not be responsible for any sightseeing missed by the passengers, on account of the optional tours, or for the amount spent by them on such tours.
- Accommodation in the hotels mentioned in the itineraries is subject to change. Although great care is taken to accommodate passengers in the hotels mentioned in the itineraries, at times, these hotels are fully booked. Under such unavoidable circumstances the passengers will be accommodated in other similar hotels.
- The company shall not be responsible for any damages / loss accrued due to acts or negligence of any air carrier, hotel, coach, company or attraction.
- Passengers are requested to check all documents, visas, etc.
- All complaints / claims must reach Equino Fun Holidays' office in writing within 30 days after the tour concludes. Otherwise, the same will not be entertained.
- Refunds, if any, will be made by cheque only.
- The company can exercise the right to alter / vary or withdraw any facility it has advertised or published. This change may be needed in the large interest of the group or due to unavoidable circumstance. In such a case the company is
not liable to pay any compensation.
- Airline is subject to change without prior notice.
Itinerary accuracy: The information given in the itinerary is as accurate as we can make it. Our itinerary descriptions are of amenities normally available. However, circumstances can change due to any events beyond our control. Major road works/ blocks may necessitate route changes. Indian restaurant may close or change management. All of this may cause us to make changes in the itinerary
and/ or meal arrangements. Where we may know of these sufficiently in advance, we will notify you. Otherwise, our tour manager or local representative will inform you of the changes on the spot. Please note that the itinerary is prepared much in advance.
Currency and travelers' cheque: We suggest you take your holiday spending money partly in currency, partly in travelers' cheque's. Travelers' cheque's are by far the safest way to carry money as they are easily en cashed for a small service fee and can be replaced if they are stolen or lost, provided you have the lost travelers' cheque numbers and the counterfoil.
Tipping is customary in all parts of the world for services rendered (e.g. porters, coach drivers etc.). Your tour manager will be pleased to advise you of the same.
Refund: The company reserves the right to determine the quantum of refund payable in case of cancellation or amendment of a tour due to force majeure or vis majeure. Such refund would be based on various factors like the number of participants; the cancellation policies of suppliers like hoteliers, coach operators, etc. And the decision of the company on the quantum of refund shall be final. Refunds (if any) for amendments and / or cancellation will be paid directly to tour participants by the company. It would take at least 45 days to process such refunds.
In case the company exercises its discretion to alter, amend or cancel any tour advertised in the itinerary and the tour participant who has registered for such tour exercising the option to continue with the tour as altered or amended, or to accept any alternative tour which the company may offer, the company shall not be liable for any compensation, damage, additional expense or consequential loss suffered by him/ her or to pay any amount as refund to the tour participant.
Even in case of a tour for which the payment was made in foreign currency with or without part payment in Indian Rupees, the said refund shall be made only in Indian rupees at the prevailing rate on date of refund as per existing rules and regulations.
There shall be no refund if you fail to join the group at the commencement to the tour, or join the group late or leave the group before culmination of the tour.
There shall be no refund if you do not or cannot utilize any service included in the tour cost of the tour like meals, rooms, excursions, etc. Nor can any refund be made for lost, mislaid or destroyed travel tickets or vouchers.
